1. General

These general terms and conditions apply to the purchase of gift cards issued by EVINO DANILO d.o.o., Business Unit Danilo gostilna & vinoteka, Reteče 48, 4220 Škofja Loka on the website www.danilogostilna.si

Danilo (seller) allows the buyer of online sales (buyer) before the purchase an insight into the offer and prices or the value of gift cards. The value of the gift card is indicated by the customer. Gift cards usually have € 50, € 100 and € 2,000 credit. Gift cards are transferable and redeemable for the services and products offered by the seller.

The buyer receives a confirmation of purchase to the e-mail address.

Online sales are available 24 hours a day.

The seller reserves the right to change these general terms and conditions at any time without prior notice, and it should be noted that the buyer's purchase is governed by the general terms and conditions of sale in force on the day of the purchase.

2. Purchase

On the website www.danilogostilna.si, it is possible to purchase gift cards with marked values.

For each online purchase, the customer must agree to the Terms of Online Sale of Gift Cards. By confirming the purchase of the gift card, the buyer expressly agrees that he is fully acquainted with the provisions of these general terms and conditions and that he fully accepts and confirms them.

From the list of gift cards, the customer first selects a gift card with the selected value and adds it to the shopping cart. The customer can purchase an unlimited number of gift cards in the shopping cart, and all of them are subject to the same conditions for purchasing them.

The buyer at the time of purchase provides or. enters the following information:

• Name and surname
• e-mail
• Phone Number
• home address

Then indicate the method of payment and the method of receipt of the gift card.

After completing the online purchase, the customer receives an e-mail confirmation of purchase with all information about the order.

3. Payment, collection

The buyer pays the purchase price for the ordered gift cards via the website, via the paypal system or physically at the seller's cash register. The buyer indicates the method of payment. Online payment with a bank card is protected and managed by PayPal, recognized by banking institutions.

The buyer chooses the method of collecting the ordered gift cards, via e-mail in pdf format, or at the seller's headquarters on the basis of a previous order. Receipt of gift cards at the seller's headquarters can be done during the restaurant's working hours.

4. Liability, cancellation, replacement

The seller is not responsible if the buyer does not pick up the ordered gift card received in pdf format to the e-mail address or does not take it physically at the seller's headquarters.

Also, the seller is not responsible if the buyer loses the gift card, destroys it or otherwise disables its use. The seller does not issue duplicate gift cards.

Gift cards are valid for 1 (one) year from the date of issue. The use of the gift card must be booked in advance at info@danilogostilna.si or by phone 04 / 5153-444. The holder submits the gift card when getting the service in the seller's restaurant.

Replacement of a gift card for cash or money is not possible. It is also not possible to extend its validity or replace it in case of loss, destruction or damage. In these cases, the buyer is also not entitled to any refund. The gift card can only be redeemed in full credit and can only be used once.

The gift card is valid within the information written on it:

• Identification Number
• gift card value
• date of issue of the gift card
• valid and redeemable
• signature of the issuer

The buyer is entitled to assert the seller's liability for material errors within the deadlines and in accordance with the provisions of the applicable Consumer Protection Act.

The buyer has the right to inform the seller within 14 days of receiving the ordered gift card that he or she withdraws from the contract and at the same time returns the gift card to the seller without having to state the reason for his decision (this applies only to individuals who receive a gift card for a purpose outside its gainful activity). The cost of returning the gift card is borne in this case by the buyer.

In order to exercise the right of withdrawal, the buyer must notify the seller of his decision to withdraw from the contract by an unequivocal statement (eg by letter sent by post or e-mail). For this purpose, the customer may optionally use the enclosed sample withdrawal form.

In order to comply with the withdrawal period, it is sufficient that the notice concerning the exercise of the buyer's right to withdraw from the contract is sent before the expiry of the withdrawal period.

5. Security and privacy of personal data

The seller undertakes to protect the confidentiality of personal data of users of the website. The collected data will be used exclusively for the purposes for which they were collected for or provided by customers and for improvements of online sales. We will not use personal data and contact information for other purposes and we will not disclose them to third parties without the express permission of the user of the website, unless required by law. We will do our best to protect the data of the users of the website from any violations and abuses.

All personal customer data is stored in the seller's database, except for payment card data. This information is processed on the bank's website and must be provided again when purchasing. The protection and processing of payment card data is ensured by the bank, which enables secure transactions.

All data provided by the buyer will be the exclusive property of the seller and protected in accordance with the legislation defining the protection of personal data. They will only be used with the consent of the buyer and in such a way that the seller will be able to ensure a smooth online purchase process. At the customer's request, they will also be used to provide notifications, offers, news.

The seller in accordance with para. Article 32 The Out-of-Court Settlement of Consumer Disputes Act states that it does not recognize any IRPS provider as competent for resolving consumer disputes that would arise in online sales procedures under these General Terms and Conditions.

The purchase receipt received by the customer by e-mail is not valid instead of the gift card and the customer cannot use it to claim the paid service. At the point of sale (in the restaurant) of the seller, the buyer must present it exclusively with a gift card, which he receives to the e-mail address in pdf format, or picks it up in person at the seller's headquarters.

Protection of personal data
The company respects the importance of personal data protection, so we handle your data in accordance with the General Data Protection Regulation (GDPR).

With your consent, we obtain personal information from various online or written sources.The data that can be stored for the purpose of notifications are:

• name and surname,
• demographic data (gender, age, date of birth),
• contact details (web address, telephone number),
• information on event attendance and shopping habits.

In the interest of effective cooperation and compliance with the law, we guarantee every individual the right to:

• access to personal data (review),
• correction / supplementation of personal data,
• restrictions on the processing of personal data,
• portability of personal data,
